Article of Agreement made and entered into this 23rd day of September, 1864, between Daniel Lafever, of the first part, and Daniel Fleming, of the second part, and both of the County of Berkeley, and the State of Va. Witnesseth that for and in consideration of a certain amount of grain, the said Daniel Lafever, of the first part, agrees to rent and by these presents hath rented to Daniel Fleming, his farm lying on the Potomac River, and now in the accompany of Joseph Beavis, for one year from the first day of April 1865 until the first day of April 1866, and the said Daniel Fleming, of the second part, agrees and binds himself, his heirs, &c, to deliver unto the said D. Lafever, or his heirs, &c, two fifths of all the grain grown on the farm; wheat, rye, corn & oats, as rent at either of the following named places to wit, Little Georgetown, or the four locks on the canal, also the said D. Fleming, agrees and binds himself to farm such fields and in such a way as herein named. The fields that is now in corn is to be planted or farmed again in corn, and also the field adjoining the above one in the north or towards the river and which field is to be ploughed or broken up this fall, and for wheat, the second field from the river on the right hand side as you go towards the house, but before being sowed in wheat, this field is to be broken up in the spring and sown in oats, and the second field to be seeded or sown in wheat, the said D. Fleming having the privilege of either field on the right or left of the former, or first mentioned field, or the field which is to be sown in oats & wheat, and also the field first named that is to be farmed in corn is to be sown down in rye in the fall, and also the said D. Fleming agrees and binds himself to do all the farming on the farm in proper time and in good farming like order, and to put and keep the farming in good order making as many rails as necessary for the same, but to cut or fell no more timber for any other purpose, the dead timber or sap of the trees from which rails has been taken to be used for fuel, and also the said Fleming agrees if the weather will admit to saw one stubble field down in wheat this fall 1864, and in the spring in clover seed it being on the same conditions in rent as above mentioned, and lastly the said Fleming agrees and binds himself, his heirs, &c, to give peaceable and quiet possession on the first day of April 1866, and Lafever on his part agrees and binds himself, &c, to give the said Fleming the full right of ingress and egress to harvest and thrash and deliver his crops and also agrees to give the said Fleming the refusal of the farm for a second year providing the said Fleming complies faithfully with the above articles of agreement, providing the farm should not be sold, and in witness to the same we both sign our names and affix our seals this day and year herein above written.
